infringers, and the Chinese Authorities, if they took cognizance of the convention, would probably so construe it. Yet further, if a Japanese pirate had acquired in Japan the right to a British trade wark, he would, under the convention, be in a position in all pro- -bability to establish his right to it in China as against the British owner.

The Manchester Chamber, after hearing Mr. Crowe's argument, confirm their letter of the 13th. May that, unless un- -registered marks are properly protected, they would prefer not to have a convention.

In England property in a trade mark or description is acquired by user, in Japan such property is apparently conferred by process of law; and as long as this fundamental difference exists it would seem to be impossible to frame a convention which would be satisfactory both to the British and to the Japanese merchant.
